2. Intellectual Property
2.1 Ownership of Content
All content made available on this Site, including but not limited to nursing diagnoses, definitions, taxonomies, classifications, terminology, explanatory text, layouts, tables, graphics, digital products, downloadable materials, and related documentation (collectively, the “Content”), is owned by the International Nursing Knowledge Association (INKA) (formerly NANDA International) or its licensors and is protected by United States and international copyright laws, database rights, and other applicable intellectual property laws.
Except as expressly permitted under these Terms or pursuant to a written license agreement with INKA, no rights are granted to use, reproduce, distribute, modify, adapt, translate, or create derivative works from the Content.
2.2 Trademark Protection (Name, Brand, and Identity)
NANDA® is a registered trademark of the International Nursing Knowledge Association (INKA) (formerly NANDA International). All related names, logos, service marks, word marks, and brand identifiers displayed on this Site (the “Marks”) are the exclusive property of INKA.
Use of the Marks is strictly limited to identifying INKA as the source of its goods and services. You may not use the Marks in any manner that:
- implies endorsement, sponsorship, or affiliation with INKA without authorization
- suggests that INKA approves of or is responsible for third-party content, products, or services
- incorporates the Marks into product names, service names, titles, branding, or domain names
- creates a likelihood of confusion as to origin, ownership, or association
Any commercial or promotional use of the Marks requires prior written permission from INKA.
2.3 Copyright and Licensed Use of Content
The Content made available on this Site is protected independently of the NANDA® trademark. Use of INKA Content is governed by copyright law and, where applicable, by licensing agreements.
Unless expressly authorized in writing by INKA, you may not:
- reproduce, publish, distribute, or publicly display the Content
- translate, adapt, modify, or create derivative works based on the Content
- incorporate the Content into software, applications, databases, academic platforms, electronic health records, decision-support tools, or other digital systems
- upload or redistribute the Content on third-party websites, repositories, or platforms
Certain uses of Content, including educational, institutional, technical, or commercial applications, may require a formal license. Licensing requirements depend on the nature, scale, and purpose of the use.

Fair Use and Scholarly Reference
Nothing in these Terms is intended to override, limit, or waive any mandatory exceptions or user rights provided under applicable copyright or database protection laws in any jurisdiction. Limited quotation or reference to INKA Content for purposes such as scholarly research, academic commentary, criticism, teaching, or citation may be permissible where such use is non-systematic, does not reproduce substantial portions of the Content, does not substitute for the original work, and does not replace, replicate, or materially diminish the need for licensed access to the Content.
2.4 Prohibition on Text Mining and Data Extraction
You may not engage in automated or manual text mining, scraping, data extraction, indexing, or systematic retrieval of Content or structured data for the purpose of reproduction, analysis, redistribution, training machine learning or artificial intelligence models, or creating derivative works, unless you have obtained explicit prior written authorization from INKA.
2.5 Attribution Requirements
Where reference to Content is expressly permitted, proper attribution acknowledging INKA, the International Nursing Knowledge Association (formerly NANDA International), as the source is required. Attribution does not grant permission to reproduce or reuse Content beyond the scope expressly authorized.
Failure to provide required attribution constitutes a violation of these Terms and may result in revocation of permissions or licenses.
2.6 Commercial Use and Licensing
No commercial use of the Content or the Marks is permitted without a formal written licensing agreement with INKA. Commercial use includes, but is not limited to, incorporation into software products, electronic health records, clinical or educational platforms, assessment tools, publications, training programs, or monetized services.
Unauthorized commercial use may result in enforcement action to the fullest extent permitted by law.
2.7 Enforcement
INKA actively monitors for unauthorized use of its trademarks and copyrighted Content. We reserve the right to pursue legal remedies, issue takedown requests, revoke licenses or permissions, and restrict access to the Site in response to violations of these Terms or applicable law.
